PRESIDENTIAL ANTI-GRAFT COMMISSION (PAGC) PRESS RELEASE 14 January 2008 MALACAÑANG AFFIRMS PAGC RECOMMENDATION TO DISMISS DBM BUREAU DIRECTOR The government-wide anti-graft crusade continues to show strength as Malacañang hands down a series of dismissals and suspensions to several government officials based on recommendations made by the Presidential Anti-Graft Commission (PAGC). In its latest released Decision dated December 14, 2007, the Palace found VIRGINIA G. GARRIEL, Director of the Systems and Procedures Bureau (SPB) of the Department of Budget and Management (DBM) guilty of violating Section 3(e) of RA 3019 and Section 4 of RA 6713, affirming an earlier PAGC recommendation for Garriel’s dismissal. Garriel was slapped with the penalty of DISMISSAL from service after she was proven to have given undue favor, in separate occasions, to the Palawan Council for Sustainable Development (PCSD), the DENR-Environmental Management Bureau (Region 5), and the Bukidnon Provincial Environment and Natural Resources Office (PENRO) by causing the premature release of Notices of Cash Allocation (NCAs) to the said agencies. PAGC’s investigation was prompted by an anonymous complaint which claimed that Garriel was seen accepting “rewards in cash or in kind” in exchange for the release of NCAs to some government agencies, even though they were not yet scheduled for release. PAGC’s investigation efforts uncovered evidence which sufficiently proved that in three (3) separate Memoranda for then DBM Secretary DBM Secretary Emilia Boncodin, Garriel falsely claimed that her bureau received requests from PCSD, DENR-EMB, and Bukidnon PENRO at certain dates which were months earlier than the dates when they were actually received. Such misrepresentations violated the first-in, first-out procedure required in the Budget Execution Guidelines released by the DBM for the said agencies’ requests for payment. Section 3(e) of RA 3019, also known as the Anti-Graft and Corrupt Practices Act, prohibits government officials and employees from giving any private party any unwarranted benefits, advantages or preferences in the discharge of their administrative and judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence. Meanwhile, Section 4 of RA 6713 or the Code of Conduct and Ethical Standards of Public Officials and Employees requires those in the government service to observe commitment to the public interest, professionalism, justness and sincerity in the discharge and execution of their official duties. The penalty of Dismissal from service carries the accessory penalties of cancellation of civil service eligibility, forfeiture of leave credits and retirement benefits and disqualification from re-employment in the government service. # |
