PRESIDENTIAL ANTI-GRAFT COMMISSION (PAGC) PRESS RELEASE January 4, 2007 NLRC LABOR ARBITER SUSPENDED FOR FAILURE TO FILE SALN Palace has affirmed the Presidential Anti-Graft Commission’s (PAGC) recommendation for a one-month and one-day suspension of Labor Arbiter Henry D. Isorena of the National Labor Relations Commission (NLRC) of Region III for failure to submit Statement of Assets, Liabilities and Net Worth (SALN) in 2002. The Office of the President, through Executive Sec. Eduardo Ermita has approved the resolution last December 28, 2006. Failure to submit SALN constitutes a violation of Section 8 of the Code of Conduct and Ethical Standards for Public Officials and Employees in relation to Section 7 of the Anti-Graft and Corrupt Practices Act. “All public officials are mandated to submit their Statement of Assets, Liabilities and Net Worth every year. They should not rely nor blame their administrative staff for failure to remind them of their obligation,” PAGC Chair Constancia de Guzman said. The case stemmed from a complaint against the respondent received by PAGC for ill gotten wealth. Investigation revealed that Isorena failed to file his SALN for 2002. The defendant’s assets for 2002 include two parcels of land both located at the Bagbaguin, Meycauayan, Bulacan; a Delica Passenger Van, a 1977 Mitsubishi Gallant Sigma and a Honda City. Aside from sickness and work overload, Isorena also faulted the NLRC Region III Administrative Department’s failure to remind him to file his SALN 2002. Notwithstanding, PAGC decided that Isorena’s reasons regarding his health and work load are unmeritorious, and his reliance on the review and compliance procedure of their administrative division unjustifiable. “I wish to reiterate that the review and compliance procedures are established to check whether the SALN is properly accomplished. This does not mean that the personnel implementing these are tasked by law to remind public officers of their duty to file their SALN,” de Guzman closes. |
