OP okays PAGC’s sacking of BIR

exec for failure to declare assets 

            The Office of the President recently affirmed the recommendation of the Presidential Anti-Graft Commission (PAGC) for the dismissal of a regional director of the Bureau of Internal Revenue in Mindanao for failure to declare real properties under his name in his Statement of Assets, Liabilities and Net Worth (SALN) as mandated by law. 

            Regional Director Hadji Mama Bae Marzoc of Revenue 15 of the BIR was found guilty of violating Section 7 of Republic Act No. 3019, Section 8 of Republic Act No. 6713 and Sections 46(b) [1], [3], and [13], Chapter 7, Sub-Title A, Book V of Executive Order No. 292 and was dismissed from service in a Decision rendered in O.P. Case No. 07-B-065 dated June 25, 2007 and signed by the Honorable Eduardo R. Ermita in his capacity as Executive Secretary. 

Marzoc's dismissal carried the accessory penalties of cancellation of his eligibility, forfeiture of his leave credits and retirement benefits, and disqualification for reemployment in the government service. 

The case stemmed from a letter -complaint dated December 23, 2005 filed by a certain Manchang Ang with the PAGC charging Marzoc with violations of Section 7 of Republic Act No. 3019, Section 8 of Republic Act No. 6713 and Section 46(b) [1], [3] and [13], Chapter 7, Sub-Title 7, Book V of Executive Order No. 292. 

Records show that Marzoc failed to declare in his 2003, 2004 and 2005 SALN residential lots in his name with TCT Nos. T-42127 and T-42011 both located in Cotabato City. He also failed to state in his SALN six properties in Usman Subdivision, Bagua 2, in the same city, which he paid tax declarations with him as owner/co-owner.  

After due investigation, the PAGC found Marzoc guilty of the charges and recommended in its Resolution dated February 16, 2007, that he be dismissed from the service, with cancellation of eligibility, forfeiture of leave credits and retirement benefits, and disqualification for reemployment in the government service, to which the OP affirmed. 

Marzoc’s dismissal is a positive sign in the PAGC’s unwavering fight against graft and corruption in the light of the latest survey of the Social Weather Stations (SWS) on corruption, which unfairly branded the PAGC as one of the government agencies with “mediocre sincerity” in curbing graft and corruption.  

According to Chair Constancia De Guzman, the PAGC will make use of the SWS survey as a basis for drawing up new strategies and programs that could be introduced in government entities that scored low in the survey. #
