Office of the President PRESIDENTIAL ANTI-GRAFT COMMISSION (PAGC) PRESS RELEASE November 30, 2006 PAGC DENIES SAN ANDRES RESIGNATION FROM DND – HE WAS DISMISSED “Former Assistant Secretary Ricardo San Andres was dismissed from the Department of National Defense (DND),” Chairman Constancia de Guzman of the Presidential Anti-Graft Commission (PAGC) asserted to clarify San Andres’ statement that he resigned from his DND post, which is co-terminus with his appointing official. This was also in refutation of the list of resigned personnel that DND released yesterday. San Andres was discharged from office following PAGC’s investigation that found him guilty of receiving double compensation after he collected his salaries and other benefits from DND at the same time that he was working for a special project with the European Commission (EC). The project where San Andres helped to implement the Health Sector Reform Agenda in essence contracted him as an EC employee during its 50-day duration. San Andres was meted with the penalty of dismissal from service with the corresponding accessory penalties of perpetual disqualification to hold public office, cancellation of eligibility and forfeiture of government financial benefits for violating Republic Act 3019, or the Anti-Graft Law and Executive Order 292 or the Administrative Code of the Philippines. While San Andres was given a 15-day period to file his Motion for Reconsideration at the Office of the President (OP), he has yet to submit his petition. Decision and orders issued by the Office of the President become final unless a motion for reconsideration is filed within the given prescriptive period. To date, sixty (60) days has lapsed from the time the OP’s order on San Andres’ case was issued last 22 September 2006, making it final and executory. Chairman De Guzman likewise denied that San Andres' position is co-terminus with his appointing official since he is a Career Executive Service Officer (CESO). |
