Office of the President PRESIDENTIAL ANTI-GRAFT COMMISSION (PAGC) PRESS RELEASE OCTOBER 12, 2006 ANTI-GRAFT COMMISSION SLAPS SUSPENSION TO CEBU DIVISION SUPERINTENDENT Presidential Anti-Graft Commission Chairman Constancia de Guzman issued a three-month suspension without pay to Toledo City schools Division Superintendent Dr. Jose C. Cabantan for refusal to release the Performance Rating for the School Year (SY) 2002-2003 of Ms. Babylonia Ubas. Ms. Ubas accused Dr. Cabantan of oppression, grave abuse of authority a violation of Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees. Cabantan earlier filed a motion for reconsideration of Office of the President’s Order affirming PAGC’s recommendation. This, however, was denied with finality through a resolution issued by the Executive Secretary Eduardo Ermita last September 22, 2006 with a stern warning that the repetition of the same act shall be dealt with more severely. "As a public official, Dr. Cabanatan is under legal obligation to perform his duties faithfully. We hope that this should serve as a warning to all. PAGC will not hesitate to penalize individuals who break the law," de Guzman said. PAGC investigation showed that the respondent failed to act on several requests of the complainant, Ms. Babylonia Ubas for a copy of her Performance Rating for the School Year 2002-2003. Records also disclosed that the case was elevated to Regional Director Carolino B. Mordeno of DepEd Region VII, but due to inaction, Ms. Ubas was prompted to file her complaint to the Civil Service Commission. However, CSC referred the case to the Office of the President, through Presidential Assistant for Visayas on the grounds that Dr. Cabantan was a presidential appointee and falls under the direct disciplining power of the Chief Executive. De Guzman stressed that, “No matter how light is the offense, the law should be implemented.” # |
